END USER LICENSE AGREEMENT (EULA): PortDic
This End User License Agreement (hereinafter referred to as the "Agreement") is a legal agreement between the PortDic Development Team (hereinafter referred to as the "Developer") and any individual or legal entity (hereinafter referred to as the "User") who downloads, installs, copies, or uses the software product and related services (hereinafter referred to as "PortDic" or the "Software").
By installing or using "PortDic", the User agrees to be bound by all the terms and conditions of this Agreement. If you do not agree to these terms, you are not authorized to install or use the Software.
Article 1 (Grant of License and Classification of Services)
Standard License: The Developer grants the User a non-exclusive, non-transferable license to install and use the core features of "PortDic" in accordance with the terms of this Agreement. This Standard License is provided free of charge to all Users, including for personal, corporate, and commercial purposes.
Paid Services: The Developer reserves the right to provide certain advanced features, add-on services, cloud integration, or technical support (hereinafter referred to as "Paid Services") under separate paid subscription or pricing plans. To use such Paid Services, the User must agree to separate terms of service defined by the Developer and pay the specified fees.
Article 2 (Retention of Rights and Ownership)
Intellectual Property Rights: All intellectual property rights in and to "PortDic"—including but not limited to its source code, binaries, UI/UX design, core conversion logic, related documentation, and any components contained within the Software—belong exclusively to the Developer.
Ownership of Outputs: All ownership, copyright, and intellectual property rights in and to any data outputs, models, or files generated, converted, or modeled by the User using "PortDic" belong entirely to the User. The Developer claims no rights or ownership over the User's local assets and outputs.
Article 3 (Use of User Information for Service Improvement)
Data Collection and Purpose: The Developer may collect and utilize information regarding the User's software usage patterns, feature frequency, system logs, and crash reports for the purpose of improving services, which includes error diagnosis, feature enhancement, performance optimization, and user experience (UI/UX) analysis.
Anonymization and Security: When utilizing the collected information pursuant to the preceding paragraph, the Developer shall ensure that the data undergoes complete anonymization (de-identification) and encryption to prevent any leak of personal information, proprietary domain knowledge, original target documents, or source code.
Consent and Withdrawal: The User may opt-in or opt-out of data collection for service improvement at any time via the settings menu within the Software.
Article 4 (Restrictions on Use)
The User shall not engage in any of the following activities. Any violation may result in the immediate termination of this license:
Reverse Engineering: Attempting to reverse engineer, decompile, disassemble, or extract the source code of the Software.
Unauthorized Redistribution and Commercialization: Modifying the binaries or core components of the Software to sell, lease, rent, or redistribute them to third parties for a fee, or misrepresenting the Software as the User's own creation.
Circumvention of Paid Services: Bypassing, disabling, or disrupting the authentication mechanisms of the Paid Services provided by the Developer, or using them in an unauthorized or abnormal manner.
Article 5 (Disclaimer of Warranties and Limitation of Liability)
Provided "AS-IS": The Software is provided on an "AS-IS" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of fitness for a particular purpose, performance, or error-free operation.
Limitation of Liability: To the maximum extent permitted by applicable law, the Developer shall not be held liable for any direct, indirect, incidental, or consequential damages (including but not limited to industrial equipment malfunctions, data loss, business interruption, or economic loss) arising out of the use or inability to use the Software. The User bears full and sole responsibility for final verification and validation when implementing and deploying industrial protocols in production environments.
Article 6 (Modification of Agreement and Introduction of Paid Services)
Service Modifications: The Developer reserves the right to modify, add, or restrict parts or the entirety of the services provided, as deemed necessary for operational requirements or feature improvements.
Changes to License and Pricing Policies: The Developer reserves the right to modify its license and pricing policies in the future, including the introduction of Paid Services or transitioning existing features to a paid model (provided that such changes are within a reasonably notified scope). Any changes to pricing policies will be announced through official channels at least 30 days prior to enforcement. Continued use of the Software after such notice constitutes the User's agreement to the revised policies.
