WHALE'S SECRET SCRIPTAPILIB LICENSE AGREEMENT

This License Agreement ("Agreement") is a legal agreement between you ("User") and AITIS s.r.o. ("Licensor") for the user of Whale's Secret ScriptApiLib ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this agreement.

1. GRANT OF LICENSE

1.1 Free Mode
   Licensor hereby grants User a non-exclusive, non-transferable, and limited license to use the Software in its free mode ("Free Mode") without charge. The free mode is subject to certain limitations as described in this Agreement and within the Software itself.

1.2 Paid Mode
   To operate the Software without the limitations of the Free Mode ("Paid Mode"), User must purchase a license from Licensor. Upon payment of the applicable fees, Licensor grants User a non-exclusive, non-transferable, and limited license to use Software in the Paid Mode. The purchased license is time limited.

2. LIMITED FEATURES IN FREE MODE
   The Free Mode includes the following limitations:
     a. Size of the orders that the User can create is limited to a certain multiple of the minimal tradable amount of the symbol pair on the target exchange market.
     b. Users have access to community-based support forums only.

3. RESTRICTIONS
   User may not:
     a. Copy, modify, distribute, or resell the Software, in whole or in part, without the prior written consent of Licensor.
     b. Rent, lease, or lend the Software.
     c. Reverse engineer, decompile, or disassemble the Software.
     d. Use the Software for any unlawful purpose or in any manner that violates applicable laws or regulations.
     e. Use the Software in Paid Mode without purchasing a valid license.

4. OWNERSHIP
   The Software is licensed, not sold. Licensor retains all rights, title, and interest in and to the Software, including all intellectual property rights.

5. TERMINATION
   This Agreement is effective until terminated. Licensor may terminate this Agreement if Licensee fails to comply with any of its terms. Upon termination, Licensee must cease all use of the Software and destroy all copies in its possession.

6. DISCLAIMER OF WARRANTY
   The Software is provided "as is" without warranty of any kind, either express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, or non-infringement. 

7. LIMITATION OF LIABILITY
   In no event shall Licensor be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Software, even if Licensor has been advised of the possibility of such damages.

8. GOVERNING LAW
   This Agreement shall be governed by and construed in accordance with the laws of the Czech Republic.

9. ENTIRE AGREEMENT
   This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

By using the Software, Licensee acknowledges that it has read this Agreement, understands it, and agrees to be bound by its terms.
