PLEX-SOLUTION SOFTWARE, INC. COMMUNITY SOURCE-AVAILABLE LICENSE (FREE FOR NON-COMMERCIAL USE)

This Community License Agreement (the “Agreement”) is a legal agreement between you (“Licensee”) and Plex-Solution Software, Inc. (“Plex-Solution”).

1. Grant of Rights: Plex-Solution grants you a free, personal, worldwide, non-exclusive, non-transferable license to download, install, and run the unaltered Software for “Non-Commercial Use” only.
2. Definition of Non-Commercial Use: Non-Commercial Use means the Software is used exclusively for personal, educational, or internal non-profit purposes. It cannot be used primarily for commercial advantage, monetary compensation, or financial reward.
3. Strict Prohibition on Sale and Monetization: You may not sell, rent, lease, sublicense, host as a paid commercial service, or otherwise monetize the Software or any portion of it.
4. Strict Prohibition on Modification: You are NOT permitted to modify, translate, reverse engineer, decompile, disassemble, or create derivative works based upon the Software. You must use the Software strictly in its original, unmodified form.
5. No Open-Source Status: This is a source-available license, not an open-source license. Redistribution of modified versions is strictly prohibited.

By installing, copying, or otherwise using the Software, you confirm your agreement to these terms. If you do not agree, you are not authorized to use the Software.

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. PLEX-SOLUTION SOFTWARE, INC. MAKES NO WARRANTY THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS.

LIMITATION OF LIABILITY

IN NO EVENT SHALL PLEX-SOLUTION SOFTWARE, INC., ITS AUTHORS, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE. THIS INCLUDES, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
