License and terms and conditions of use

This license provides copyright, author's rights and intellectual property rights, and reserves patent rights.
This source is released as open source (in the terms definition in the glossary) to demonstrate product quality, security and privacy levels.
The philosophy that follows the release of the code is the trustless concept: you do not have to believe the authors of the software, but rather the source code as a demonstration of safety and quality.
The use of the code is permitted if the software produced is for personal use. Any other use of the code must be agreed with the author and a royalty plan must be established. Without a royalty agreement, the publication of software that includes elements created through the use of this code, even partially, is prohibited.
The use of the source is granted for educational, research, scientific, and safety testing purposes, provided that all other conditions included in this license are respected.
This license applies to all forks, derivative works and partial implementations derived from this project: those who use part of the code and those who use any forks (even partial) must include this license, mention the original author of the code, and pay the previously agreed royalties.
Products under this license may be subject to updates of the license version terms.

Patents

This source is also published as proof of the moment of realization of an idea or concept, and of all its derivations of patentable use with its implementation.
Any patenting of parts deriving from the ideas or concepts of this software, if registered by third parties, may be invalidated on the basis of demonstrable prior publication and authorship established by this project and its publicly verifiable publication date. The publication of this project does not mean free transfer for public use, but simply the demonstration of who was the first to create new patentable ideas and concepts, reserving the right in the future to claim everything that concerns or derives from the use and employment of this publication and the ideas and implementations that derive from it.

Authorized Forks and White-Label Licensing

Any authorized fork will be considered a "white label" license even if not expressly mentioned.
The author may grant third parties, through a separate written agreement, the right to use, distribute, commercialize or maintain authorized forks of the project.
Such authorization may be technically implemented through the transfer or creation of a fork within a repository owned or controlled by the requesting party.

No fork, derivative work, registration, deposit, publication, branding activity or third-party filing, including registrations before copyright offices, collecting societies or intellectual property authorities, shall transfer, replace, invalidate or supersede the authorship, ownership, priority rights or original intellectual property rights of the original author and original project. Any white-label authorization or authorized fork granted under this license shall be considered personal, limited, non-transferable and non-sublicensable unless explicitly stated otherwise in a separate written agreement signed by the original author. No authorized party may redistribute, transfer, sublicense, assign, resell, grant usage rights or provide copies of the software, source code or derivative works to third parties beyond the scope explicitly permitted by the original author.

Priority

This license and its terms shall prevail over any subsequent attribution, registration, ownership claim, license term, assignment, publication, repository metadata, branding activity or third-party declaration that conflicts with the provisions of this license. No later modification, redistribution, registration or attribution performed by third parties shall invalidate, replace or supersede the original terms, authorship, ownership or intellectual property rights established by this license and the original publication of the project.

This software is provided "as is", without warranty of any kind, express or implied, including but not limited to security, availability, merchantability, fitness for a particular purpose or non-infringement. In no event shall the author be liable for any claim, damages or other liability arising from the use, misuse or inability to use the software or any derivative work.

“License Updates”

New versions of this license may be published in the future.
Unless otherwise agreed in writing, recipients may continue using the version of the license originally distributed with the software copy they received.

Glossary and Interpretation of Terms

“Open Source”

Within this license, the term “open source” exclusively refers to source code that is publicly accessible, viewable and auditable through a public repository.
It does not imply unrestricted rights to use, modify, redistribute, sublicense, commercially exploit or create derivative works unless explicitly authorized by this license or by a written agreement with the author.

“Personal Use”

“Personal use” means private and non-commercial use of the software without direct or indirect economic benefit or distribution to third parties.

“Commercial Use”

“Commercial use” means any use intended to generate direct or indirect economic benefit, including business, professional, organizational, SaaS, consulting, resale or monetized activities.

“Derivative Work”

“Derivative work” means any software, source code, implementation, modification, adaptation, fork, rewrite or product derived in whole or in part from this project or its source code.

“Royalty Agreement”

“Royalty agreement” means a separate written agreement approved by the author that defines authorized commercial use and applicable royalties or compensation.

“Prior Art”

The publication of this project constitutes demonstrable prior art and evidence of authorship regarding the ideas, concepts and implementations contained within the project, subject to applicable laws and jurisdictions.
